Who runs this site
This site is operated by Thomas Gaultier, trading as TG Mediation Services, in Portugal. Contact: thomas@thomasgaultier.com.
This is not legal advice
I am admitted to the New York Bar, but nothing on this site is legal advice and reading it creates no lawyer-client relationship. The articles, diagnostics, checklists and books describe general practice. Your situation has facts they do not know about. Before acting on anything here, take advice from someone who has read your contract, your permit conditions and your jurisdiction.
The same applies in the other direction. Where I work as a mediator I am not acting as anyone’s lawyer, and I do not advise either party on the merits of their position.
The diagnostics and tools
The diagnostics score your answers against published criteria and return an indicative result. They are a prompt for a conversation, not an audit, a certification, or a compliance opinion. A good score does not mean a mechanism meets the UN Guiding Principles, and a poor score does not mean it breaches them.
The community tension map is compiled from public reporting. Entries reflect what has been published, which is not the same as what is true. Treat it as a signal to look into something, never as a finding about a named company.
The chat assistant
Ask the Mediator answers from my published writing. It is a research convenience and it can be wrong, incomplete or out of date. Where an answer matters, check it against the source it cites or ask me directly. Do not enter confidential information about a live dispute into it.
Copyright
The text, frameworks, figures and downloadable material on this site are mine unless credited otherwise. Social Accord Architecture, GROUNDS and REBUILD are my frameworks and their names are used as such.
You are welcome to quote from the articles with attribution and a link. You may print and circulate the downloadable checklists inside your own organisation. You may not republish whole articles, sell the material, or use it as training content in a paid programme without asking me first. Ask, and the answer is usually yes.
Links out
Where I link to another site, including Amazon for the books and theaccordgame.com for the simulation, that site has its own terms and I do not control what it does.
Availability
I make no promise that the site or the tools are available without interruption. They are provided as they are, and to the extent the law allows I am not liable for loss arising from using them or from being unable to.
Governing law
These terms are governed by Portuguese law, and the courts of Portugal have jurisdiction over any dispute arising from them. This does not affect any right you have as a consumer to bring proceedings where you live.
